Chevron is the current Lessee of the above-described real property, apparently <br /> owned by the Plaintiff, Lincoln Properties, Ltd. The Site is being utilized as a retail service <br /> station location. <br /> As part of its operations at the site, Chevron has performed soil and groundwater sampling. <br /> Soil samples taken in the vicinity of the underground fuel storage and waste oil tanks did not <br /> disclose the presence of hydrocarbon contamination in excess of applicable action levels. <br /> Seven groundwater monitor wells have been installed on the site between January of 1987 <br /> and August of 1993. Low levels of TPHG and Benzene have been detected in the <br /> groundwater, and since November of 1990, the presence of dry cleaning solvents (TCE & <br /> PCE) has been detected in four of the seven monitor wells on site. PCE has been detected at <br /> Levels as high as 10,000 ppb. <br /> Chevron's operations have in no way contributed to the presence of the solvent contamination <br /> detected in the groundwater beneath the site. If Chevron should be required at any time in <br /> the future to remediate either soil or groundwater hydrocarbon contamination, and such <br /> efforts are either complicated or made more costly as the result of the presence of solvent <br /> contamination, the settlement being reached in these proceedings should not be permitted to <br /> serve as a bar to any future cause of action Chevron may acquire for contribution against <br />
