Higgins, et al. , Case No-:` Civ-S- <br /> 91-760 DFL (GGH) : Letter Report Submitted Pursuant to <br /> Permanent Injunction <br /> Dear Interested Parties: <br /> This information is provided pursuant to Sections IV(A) (1) (f) and <br /> IV(F) (Letter Reports) of the Permanent Injunction Governing <br /> Investigation, Monitoring, and Testing of Hazardous Substance <br /> Contamination at and Emanating from Lincoln Center ("Permanent <br /> Injunction") issued by Judge Levi, and filed on August 16, 1993 . <br /> The Permanent Injunction specifies that the Letter Reports shall <br /> contain any data generated in the course of the Remedial <br /> Investigation, Risk Assessment, Feasibility Study, and Treatability <br /> Study not previously submitted in draft or final reports or in <br /> previous letter reports. Since the Letter Report of April 1, 1994 <br /> no data has been generated as specified by the Permanent <br /> Injunction. <br /> Site access issues remain unresolved, precluding the Dry Cleaning <br /> Defendants from performing the Work mandated by the Permanent <br /> Injunction until resolution of these issues. <br /> Upcoming Activity: <br /> The issue of sample analysis and data reporting procedure has been <br /> submitted for formal dispute resolution before Judge Weinstein. A <br /> date has not been set for the hearing but is forthcoming in the <br /> near future. <br /> As a reminder, the date for submittal of the Final Workplan has <br /> been extended until after the lab returns data obtained from <br /> confirmation sampling of existing monitoring wells and the data is <br /> incorporated into the Final Workplan. This confirmation sampling <br /> cannot take place until site access issues are resolved. <br />
