A work plan, a well-head repair <br /> project, an updated and complete Corrective Action Plan (CAP), as well as other items <br /> noted were to be submitted by Thrifty Oil Company (TOC). As of the date of this letter, <br /> none of the items have been received at PHS-EHD. <br /> On April 1 , 1998. the California State Water Resources Control Board (SWRCB) Clean <br /> Up Fund (CUF) evaluated this site, determined that it was not in compliance, and issued <br /> a letter stating compliance sign off was to be obtained in 90 days or the claim would be <br /> removed from the Priority List. TOC was directed to contact PHS-EHD immediately and <br /> take the necessary steps needed to bring the site into compliance by July 1, 1998. <br /> On July 17, 1998, PHS-PHD responded to the incomplete CAP submitted on June 22, <br /> 1998. TOC was advised that the submittal of another incomplete CAP again caused <br /> this site to be in non-compliance. PHS-EHD directed TOC to submit a complete CAP <br /> by August 21, 1998. <br /> On September 10, 1998 PHS-EHD generated another letter to TOC stating that the <br /> required CAP has not been received and that TOC was not in compliance with <br /> directives issued by PHS-EHD. A meeting was held on November 19, 1998 to discuss <br /> TOC's failure to provide the requirements as detailed by PHS-EHD since the original <br /> directive from September 10, 1997. <br /> The SWRCB-CUF evaluated this site again in February 1999. In order to receive a <br /> Letter of Commitment for reimbursement of investigative and remedial actions, TOC <br /> must be in compliance with directives issued by PHS-EHD. Due to the failure of TOC to <br /> provide the items needed to continue with this site's required underground storage tank <br /> (UST) investigation, PHS-EHD has responded to the SWRCB evaluation request and <br /> has listed this site as "Claimant not in corrective action compliance— rejection <br /> recommended". <br /> A Division of San Joaquin County Health Care Services <br />
