Therefore, it is being proposed that Claim No 013547 be removed <br /> from the Priority List and Claim No 002156 be placed on the priority list based on the following <br /> reason: <br /> Best California Gas, Ltd never owned or operated the leaking USTs. Thrifty Oil Co was the tank <br /> owner and operator from 1989 to 1991 and Best California Gas, Ltd was the property owner <br /> from 1989 to present. The tanks were owned and operated by Tosco from 1991 to present. <br /> Tosco is a Priority D claimant. Therefore, if Claim No 013547 were an eligible claim, the <br /> Priority Class would be Priority D and not funded for some time. Claim no 002156 has a low <br /> random number and can be funded right away. I have enclosed five important documents relating <br /> to Claim No 002156 which you must complete and return as soon as possible. <br /> The first document is the "Non-Recovery From Other Sources Disclosure Certification." This <br /> document informs us of any funding you have received or may receive from other sources such <br /> as insurance, lawsuits, etc. in connection with the contamination of your site. <br /> The second document "Letter of Commitment Data Sheet" is used in determining the dollar <br /> amount that will initially be committed to your LOC. This document provides us with: (1) the <br /> eligible costs incurred to date for which you have invoices, etc. and for which you can request <br /> reimbursement; and (2) an estimate of future investigation or cleanup costs for the next six (6) <br /> months based on your proposed and approved work.
