Thrifty Oil Co. cn Barry B erkett 13539 Foster Rd E Santa Fe Springs, CA 90670 UNDERGROUND STORAGE TANK CLEANUP FUND (FUND), NOTICE OF INTENDED REMOVAL FROM PRIORITY LIST, CLAIM NUMBER 013547, AND NOTICE OF ELIGIBILITY DETERMINATION, CLAIM NUMBER 002156, SITE ADDRESS: 7647 PACIFIC AVE, STOCKTON This is to notify you that during the detailed review of your application, it has been determined that Claim No 013547 for the subject site is not eligible for reimbursement in the Underground Storage Tank Cleanup Fund. Therefore, it is being proposed that Claim No 013547 be removed from the Priority List and Claim No 002156 be placed on the priority list based on the following reason: Best California Gas, Ltd never owned or operated the leaking USTs. Thrifty Oil Co was the tank owner and operator from 1989 to 1991 and Best California Gas, Ltd was the property owner from 1989 to present. The tanks were owned and operated by Tosco from 1991 to present. Tosco is a Priority D claimant. Therefore, if Claim No 013547 were an eligible claim, the Priority Class would be Priority D and not funded for some time. Claim no 002156 has a low random number and can be funded right away. I have enclosed five important documents relating to Claim No 002156 which you must complete and return as soon as possible. The first document is the "Non-Recovery From Other Sources Disclosure Certification." This document informs us of any funding you have received or may receive from other sources such as insurance, lawsuits, etc. in connection with the contamination of your site. The second document "Letter of Commitment Data Sheet" is used in determining the dollar amount that will initially be committed to your LOC. This document provides us with: (1) the eligible costs incurred to date for which you have invoices, etc. and for which you can request reimbursement; and (2) an estimate of future investigation or cleanup costs for the next six (6) months based on your proposed and approved work. As you proceed with the cleanup process for your site, and after you obtain pre-approval for future costs and submit reimbursement requests, your LOC will be increased as needed.
