• 0 CALIFORNIA REGIONAL WATER QUALITY CONTROL BOARD CENTRAL VALLEY REGION ORDER NO. R5-2003-0125 CEASE AND DESIST ORDER REQUIRING BARREL TEN QUARTER CIRCLE LAND INC. BARREL TEN QUARTER CIRCLE INC. BARREL TEN- ESCALON SAN JOAQUIN COUNTY TO CEASE AND DESIST FROM DISCHARGING CONTRARY TO REQUIREMENTS The Regional Water Quality Control Board, Central Valley Region, (hereafter referred to as "Regional Board") finds that: 1. Waste Discharge Requirements (WDRs) Order No. 91-223 adopted by the Regional Board on 22 November 1991, prescribes requirements for Canandaigua Wine Company(hereafter referred to as "Discharger"). In July 2003, the Canandaiguia Wine Company sold the facility and land to Barrel Ten Quarter Circle Land Inc. and Barrel Ten Quarter Circle Inc (Discharger). On 5 September 2003, the Board adopted a name change order such that WDRs Order No. 91-223 applies to the new Discharger. 2. Barrel Ten - Escalon is at 21801 Highway 120, Escalon, San Joaquin County. The winery and associated Land Application Areas (LAAs) comprise approximately 128 acres (Assessor's Parcel No. 205-250-02) in Section 36, TIS, R8E, MDB&M. 3. The winery has existed since at least the 1920's; prior owners and operators include Heublein Wine, Erley Industries, United Vintners, and Canandaiguia Wine Company. BACKGROUND 4. Activities at the winery have included, or currently include: receiving and crushing grapes, fermentation, storage,wine processing treatments (clarification, filtration, cation exchange, etc.), and distribution in bulk containers. No bottling or packaging of wine is performed at the facility. Historically, a distillery was operated on-site; Canandaigua ceased operation of the distillery in April 2001 and the new Discharger has no plans for future distillation activities at the site. S. In 2001, Canandaiguia crushed approximately 83,881 tons of grapes to produce approximately 14.7 million gallons of wine and 84,000 proof gallons of distilled spirits. The maximum crush capacity of the facility, if empty, is 100,000 tons of grapes. 6. Process wastewater has been, or is, generated by the following operations: crushing/destemming, pressing, racking,fining, tank cleaning, general washdown, process equipment sterilization, wine processing, and cooling system (cooling tower blowdown and non contact cooling water). Stormwater runoff, excluding parking lot runoff, is also directed into the process wastewater system for application to the LAAs. The LAAs consist of seven evaporation/percolation basins, with a total size of 108 acres.
