CEASE AND DESIST ORDER NO. R5-2003-0125 -6- <br /> BARREL TEN QUARTER CIRCLE LAND INC. <br /> BARREL TEN QUARTER CIRCLE INC. <br /> BARREL TEN-ESCALON, SAN JOAQUIN COUNTY <br /> 3. Effective 31 January 2003, the monthly average discharge from the east and west sumps shall not <br /> exceed a total of 140,000 gallons per day(gpd) except during the months August, September, and <br /> October when a total discharge of 450,000 gpd is allowed. The monthly average discharge from <br /> the cooling water sump shall not exceed 125,000 gpd except during the months of August, <br /> September, and October when a total discharge of 175,000 gpd is allowed. <br /> 4. Beginning with the first quarter of 2003, the Discharger shall submit Quarterly Project Status <br /> Reports. The quarterly reports shall describe all work completed during the quarter in response to <br /> this Cease and Desist Order. Quarterly project status reports shall be submitted by the 1st day of <br /> the second month following the end of the quarter (i.e., the first quarter 2003 report is due by <br /> 1 May 2003) and may be combined with the monthly monitoring reports required by WDRs Order <br /> No. 91-223. <br /> 5. By 17 March 2003, the Discharger shall submit and begin implementing a Wastewater <br /> Characterization Workplan. The workplan shall describe a plan to identify all waste streams at <br /> the winery and perform sampling and analysis to characterize each waste stream. The workplan <br /> shall also address methods to determine the source of the trihalomethanes previously detected in <br /> the production wells at the facility. <br /> 6. By 2 June 2003, the Discharger shall submit a Solid Waste Disposal Plan that describes how and <br /> where solid waste is stored onsite, the locations that solid waste is disposed of(including owners' <br /> names, street addresses, and parcel numbers), the steps taken during hauling and disposal to ensure <br /> that the waste does not cause nuisance conditions or degrade the groundwater, and the entity <br /> responsible for actually applying the waste to land. <br /> 7. By 17 June 2003, the Discharger shall submit an LAA Operation and Maintenance Plan. The <br /> O&M Plan shall be prepared in accordance with Attachment A, and shall discuss all aspects of <br /> managing the discharge operation to-eomply with the terms and conditions of WDRs Order No. <br /> 91-223 (including Discharge Specifications B.5, B.6, and B.8), as well as the terms of this Cease <br /> and Desist Order. A copy of the O&M Plan shall be kept at the facility for reference by operating <br /> personnel and they shall be familiar with its contents. <br /> 8. By 1 October 2003, the Discharger shall submit a Vadose Zone Monitoring Workplan prepared in <br /> accordance with, and including the items listed in, the first section of Attachment B: Lysimeter <br /> Installation Workplan and Installation Report of Results. The workplan shall specify design <br /> details for lysimeters,proposed vadose zone monitoring locations, and proposed sampling <br /> techniques designed to ensure that representative samples of sufficient volume are obtained. <br /> 9. By 2 July 2004, the Discharger shall submit an Effluent Limitation Determination Technical <br /> Report, which identifies Constituents Of Concern (COCs) including TDS, sodium, chloride, <br /> nitrogen compounds, biochemical oxygen demand, pH, and metals in the wastewater and proposes <br /> effluent limitations that will not degrade groundwater quality. The effluent limitations must <br /> include an evaluation of the fate and transport of all COCs and clearly demonstrate that discharge <br /> of both crush and non-crush wastewater at the proposed effluent limitations will not result in <br /> groundwater degradation. <br />
