CALIFORNIA RIWONAL WATER QUALITY CO*ROL BOARD <br /> CENTRAL VALLEY REGION <br /> 3443 Routier Road,Suite A, Sacramento,California 95827 <br /> PUBLIC HEARING <br /> concerning <br /> CEASE AND DESIST ORDER <br /> for <br /> TEN BARREL QUARTER CIRCLE LAND INC. <br /> TEN BARREL QUARTER CIRCLE INC. <br /> ESCALON CELLARS <br /> SAN JOAQUIN COUNTY <br /> The Dischargers own and operate the Escalon Cellars winery at 21801 Highway 120, Escalon. <br /> The winery has operated since the 1920's and until April 2002, a distillery was also operated at <br /> the site. Wastewater is discharged to 108 acres of land. No storage capacity is available so all <br /> wastewater generated is discharged on a daily basis. Groundwater monitoring indicates that <br /> groundwater quality has been degraded by the wastewater discharge. The proposed Cease and <br /> Desist (C&D) Order provides a schedule for the Dischargers to conduct studies and then <br /> construct improvements to the wastewater system such that groundwater will no longer be <br /> degraded. This Order revises the original C&D (adopted by the Board in January 2003) to <br /> recognize the new property owner/operator and to allow a one-month time extension to all <br /> remaining due dates. <br /> A formal public hearing concerning this matter will be held during the Regional Board meeting <br /> which is scheduled for: <br /> DATE: 4/5 September 2003 <br /> TIME: 8:30 a.m. <br /> PLACE: Central Valley Regional Water Quality Control Board <br /> 3443 Routier Road, Suite A <br /> Sacramento, CA 95827 <br /> The designated parties for this hearing are as follows: <br /> • Staff of Central Valley Regional Board <br /> • Ten Barrel Quarter Circle Land Inc. and Ten Barrel Quarter Circle Inc. <br /> Only designated parties will have these rights: to call and examine witnesses; to introduce <br /> exhibits; to cross-examine opposing witnesses; to impeach any witness; and to rebut the evidence <br /> against him or her. All other persons wishing to testify or provide comments are interested <br /> persons and not designated parties. Such interested persons may request status as a designated <br /> party for purposes of this hearing by submitting such request in writing to the Board no later than <br /> 28 August 2003. The request must explain the basis for status as a designated party and in <br /> particular how the person is directly affected by the discharge. <br /> Persons wishing to comment on this noticed hearing item must submit testimony, evidence, <br /> and/or comments in writing to the Regional Board no later than 28 August 2003.
