CEASE AND DESIST ORDER NO. <br /> CANANDAIGUA WINE COMPANY <br /> ESCALON CELLARS <br /> SAN JOAQUIN COUNTY <br /> "The discharge, in combination with other sources, shall not cause underlying <br /> groundwater to be degraded. These requirements may be reopened to include additional <br /> groundwater limitations." <br /> 14. In June 2000, the Discharger constructed five groundwater monitoring wells at the facility. Based <br /> on five monitoring events, the water table exists approximately 58 feet below the ground surface. <br /> Well MW-1 is upgradient of the facility; Wells MW-2, MW-4, and MW-5 are downgradient of <br /> LAAs; Well MW-3 is downgradient of the cooling water LAAs. NO3 as N denotes Nitrate as Nitrogen. <br /> 15. As indicated in the table above, the TDS, sodium, and chloride concentrations in downgradient <br /> wells MW-2, MW-4 and MW-5 are significantly higher than that in the upgradient well, MW-1. <br /> This data indicates the discharge of waste from Escalon Cellars has degraded the underlying <br /> groundwater. <br /> REGULATORY CONSIDERATIONS <br /> 16. As a result of the events and activities described in this Order, the Regional Board finds that the <br /> Discharger has caused or permitted waste to be discharged in such a manner that it has created, <br /> and continues to threaten to create, a condition of pollution or nuisance. The Regional Board also <br /> finds that the Discharger is discharging waste in violation of WDRs Order No. 91-223, as <br /> described in the above Findings. <br /> 17. The Water Quality Control Plan for the Sacramento River and San Joaquin River Basins, Fourth <br /> Edition (hereafter Basin Plan) designates beneficial uses, establishes water quality objectives, <br /> contains implementation plans and policies for protecting waters of the basin, and incorporates by <br /> reference plans and policies adopted by the State Water Resources Control Board. Pursuant to <br /> Section 13263(a) of the California Water Code, waste discharge requirements must implement the <br /> Basin Plan. <br /> 18. Surface water drainage is to the South San Joaquin Irrigation Canal, tributary to Lone Tree Creek <br /> and the San Joaquin River in the Sacramento San Joaquin Delta. <br /> 19.
