CALIFORNIA RE-GIONAL <br /> WATER QUALITY CONTROL BOARD <br /> CENTRAL VALLEY REGION <br /> 3443 Routier Road,Suite A,Sacramento,California 95827 <br /> PUBLIC HEARING <br /> concerning <br /> CEASE AND DESIST ORDER <br /> for <br /> CANANDAIGUA WINE COMPANY, ESCALON CELLARS <br /> SAN JOAQUIN COUNTY <br /> Canandaigua Wine Company owns and operates the Escalon Cellars winery 21801 Highway 120, <br /> Escalon. The winery has operated since the 1920's and until April 2002, a distillery was also <br /> operated at the site. Wastewater is discharged to 108 acres of land. No storage capacity is <br /> available so all wastewater generated is discharged on a daily basis. Groundwater monitoring <br /> indicates that groundwater quality has been degraded by the wastewater discharge. The proposed <br /> Cease and Desist Order provides a schedule for the Discharger to conduct studies and then <br /> construct improvements to the wastewater system such that groundwater will no longer be <br /> degraded. <br /> A formal public hearing concerning this matter will be held during the Regional Board meeting <br /> which is scheduled for: <br /> DATE: 3 0/3 1 January 2003 <br /> TIME: 8:30 a.m. <br /> PLACE: Central Valley Regional Water Quality Control Board <br /> 3443 Routier Road, Suite A <br /> Sacramento, CA 95827 <br /> The designated parties for this hearing are as follows: <br /> • Staff of Central Valley Regional Board <br /> • Canandaigua Wine Company <br /> Only designated parties will have these rights: to call and examine witnesses; to introduce <br /> exhibits; to cross-examine opposing witnesses; to impeach any witness; and to rebut the evidence <br /> against him or her. All other persons wishing to testify or provide comments are interested <br /> persons and not designated parties. Such interested persons may request status as a designated <br /> party for purposes of this hearing by submitting such request in writing to the Board no later than <br /> 23 January 2003. The request must explain the basis for status as a designated party and in <br /> particular how the person is directly affected by the discharge. <br /> Persons wishing to comment on this noticed hearing item must submit testimony, evidence, <br /> and/or comments in writing to the Regional Board no later than 23 January 2003. Written <br /> testimony, evidence, or comments submitted after 23 January 2003 will not be accepted and will <br /> not be incorporated into the administrative record if doing so would prejudice any party. All <br /> interested persons may speak at the Board meeting, and are expected to orally summarize their <br /> written submittals. Oral testimony will be limited in time by the Board Chair. <br />
