Staff inspected the wastewater <br /> ponds from the adjacent Mokelumne River Resort on the same day and noted offensive odors emanating <br /> from the ponds. In addition, staff noted that the pond was not equipped with mechanical aerators as <br /> described in Waste Discharge Requirements (WDRs) Order No. 98-136. <br /> Generation of odors is a violation of California Concentrate's WDRs Discharge Specification No. B.2, <br /> which states: <br /> Objectionable odors originating at this facility shall not be perceivable beyond the limits of <br /> the property owned by the Discharger. - <br /> Historic Odor Generation Issues <br /> Nuisance odors have been a recurring problem at California Concentrate. In 1987,the Regional Board <br /> adopted a$5,000 Administrative Civil Liability Order(ACLO)for generation of odors and failing to <br /> submit a technical report to correct the problem. Despite adoption of an ACLO, California Concentrate <br /> continued to generate odors and Cleanup and Abatement Order No. 96-707 was adopted on 1 May 1997 <br /> in part, for continuing odor conditions. <br /> Most recently,the Regional Board received odor complaints on 23 December 2004. At that time, staff <br /> was informed that both mechanical aerators had been removed from the pond. A 27 December 2004 <br /> Notice of Violation(NOV)required the aerators to be immediately repaired and placed in the pond in an <br /> operable condition.
