Taber <br /> San Joaquin County Since 1954 <br /> Environmental Health Department <br /> December 22, 2003 1P2/399/245-4 <br /> Page 2 <br /> understanding that District 10 has not invoked the variance, but deals with these <br /> materials as a state hazardous waste under interpretation of DTSC standards. <br /> Caltrans (as owner of the public right of way) has a duty to see that activities <br /> undertaken for improvements meet their criteria and, although not an <br /> environmental regulatory agency, they can be considered as acting as the de <br /> facto lead agency for this project if such oversight is considered necessary. <br /> If construction does occur, soil with elevated lead concentrations will be <br /> handled in accordance with standards and procedures established by Caltrans to <br /> meet DTSC requirements and will be performed under direct supervision of <br /> Caltrans resident engineering staff that has past experience addressing <br /> excavations involving lead in soil. <br /> In consideration of the above, and on behalf of the San Joaquin County <br /> Organization of Governments (SJCOG), we request that San Joaquin County EHD <br /> waive oversight of this project by their Site Mitigation Unit.
