Gilmartin
straw and Gilmartin
100 Wilshire Blvd. , Suite 1325
Santa Monica, CA 90401
Re: Montgomery Ward Site
5400 Pacific Avenue - Stockton, California
Dear Mr. Gilmartin:
Stone Bros. and Associates has retained the firm of Weston, Inc. to IYaluate
the work plan which has been submitted to the San Joaquin Environmentall
Heal
th
Division. Their report indicates that the work plan is inadequate. A ropy of
their report is attached.
I do not know how many time Stone Bros. has requested that Montgomery Wards
clean up the site. Stone Bros. is not interested in a program that does not
completely address the problem.
It appears that unless the concrete slab or ballast, and the piping remaining
on the site are removed, these will continue to present a problem. It is my
understanding that present County protocols with respect to removal of
underground tanks resting on concrete slabs require boring through the
concrete slab, and taking samples from beneath the slab.
Further, we have no way of knowing, short of removing the slab, the deree to
which the slab is contaminated.
Our demand has been and continues to be that Montgomery Ward clean up the
site. The position of Stone Bros. is that the work plan and the assessment
program do not satisfy the demand.
We request that you implement and incorporate into your work plan, the
recommendations of Weston, Inc. , including without limitation the removal of
the concrete slab, sampling the soil beneath the slab, and such other samples
as stated in Weston's recommendations.
Very t ly yours,
Theodore I.
