R5-2002-0083 and R5-2002-0084 pending resolution <br /> of the related petition on the merits. The State Board will hold a heating to consider issuance of <br /> a stay. <br /> The purpose of this hearing is to receive any relevant testimony or evidence, and to hear policy <br /> statements, on whether to issue a stay in Lhis matter. The hearing will be limited to this purpose. <br /> The bases for a stay will be limited to the original and supplemental stay request submissions <br /> received on or prior to June 13,2002, in particular, the 12 items identified in the petitioner's <br /> Supplemental Memorandum in Support of Request for Stay, dated June 13, 2002. A stay of the <br /> effect of those portions of the orders may be granted only if the petitioner produces proof of <br /> (1) substantial harm to it or to the public interest if a stay is not granted, (2) a lack of substantial <br /> harm to other interested persons and to the public interest if a stay is granted, and(3)substantial <br /> questions of fact or law regarding the permit. The hearing will be limited to this purpose. <br /> The hearing will be held on Tuesday. July 30, 2002. The hearing may be conducted by one State <br /> Board member designated as the Hearing Officer. At the hearing,the Heating Officer will <br /> receive oral and written testimony and policy statements on the issue described above.
