v 'Now <br /> 3 - <br /> HEARING PROCEDURES <br /> To ensure that all participants have an opportunity to participate in the hearing,the following <br /> time limits will apply. Each of the patties listed above, and any other parties that are designated, <br /> will have a total of 15 minutes to present their testimony and policy statements. Interested <br /> persons will have 3 minutes to present a policy statement. Employees or representatives of the <br /> listed parties cannot speak as interested persons and must coordinate with the parties themselves <br /> if they wish to participate. Interested persons with similar concerns should participate in a joint <br /> presentation,and the State Board may limit such statements if they are repetitive. Participants <br /> are requested to avoid redundant comments. Additional time may be provided upon a showing <br /> that additional time is necessary. <br /> The State Water Board will conduct the hearing in accordance with the State Board's regulations <br /> governing adjudicative proceedings and the Administrative Procedure Act(APA). The State <br /> Board's regulations are in the California Code of Regulations, title 23, section 648, et seq. <br /> (htty://wNvw.cahses.com)or upon request. The APA provisions are at California Government <br /> Code section 11400 et seq. The hearing will not be conducted as a formal heating under <br /> Chapter 5 of the Administrative Procedure Act(commencing at Government Code <br /> section 11500). <br /> CLOSED SESSION <br /> The State Water Board may meet in closed session to deliberate on a decision to be made based on <br /> evidence taken at the hearing, either immediately following the hearing or at a subsequent time. <br /> The closed session is authorized under Government Code section 11126, subdivision(e)(3). <br /> FURTHER ACTION ON THE STAY REQUEST <br /> The Hearing Officer may rule on the stay requests through oral decision at the conclusion of the <br /> stay hearing or through a subsequent written order. The State Board may also meet in public to <br /> act on the stay request The State Board will not allow the introduction of evidence or exhibits <br /> following the close of the hearing. <br /> LOCATION AND ACCESSIBILITY <br /> The California EPA Building is accessible to people with disabilities. Public parking is available <br /> across the street from the building.
