The North Country Squires property is <br /> located north of Squires Road and east of Harlan Road in the <br /> City of Lathrop, San Joaquin County. The property is adjacent <br /> to the Defense Logistics Agency, Defense Distribution Region <br /> West, Sharpe Site (Sharpe Site) , formerly known as Sharpe Army <br /> Depot. Verner Construction, Inc. , and Lyon Communities, Inc. , <br /> intend to construct a residential development known as North <br /> Country Squires on the property. <br /> DECISION <br /> The Department of Toxic Substances Control (Department) <br /> has reviewed the "North Country Squires Property Health Risk <br /> Assessment" (Risk Assessment) dated March 21, 1991. Based on <br /> our review of the existing information, we do not believe there <br /> is a significant existing or potential health hazard to future <br /> residents at the proposed development provided that the <br /> conditions discussed below are adhered to. <br /> CONDITIONS <br /> The Risk Assessment did not evaluate exposure to future <br /> residents via ingestion of contaminated ground water. <br /> Therefore, it is necessary to restrict residents from <br /> extracting or otherwise using ground water. Also of concern is <br /> that future owners or residents of the property are informed of <br /> the contamination, and agree to the required restrictions. You <br /> have indicated your willingness to cooperate with4thir- <br /> Department to address these concerns. <br /> For these reasons, the Department is entering into a land <br /> use restriction agreement, pursuant to California Health and <br /> Safety Code, Section 25222 . 1, with Verner Construction, Inc. <br /> The enclosed deed restriction agreement will run with the land, <br />
