Upon all parties <br /> signing this deed restriction agreement, you are required by <br /> law to record the agreement with the county recorder within ten <br /> (10) days of receipt. The county recorder should be requested <br /> to index the deed restriction in the grantor index in the name <br /> of the record title owner of the property and in the grantee <br /> index in the name of the Department of Toxic Substances Control <br /> (reference California Health and Safety Code, Sections 25222. 1 <br /> (a) and 25230 (a) (1) ) . Following the execution and recordation <br /> of the agreement, the Department will notify the City of <br /> Lathrop Planning Department and the County of San Joaquin <br /> Development Services of the imposed land use restrictions. <br /> FACTS SUPPORTING DECISION <br /> The Risk Assessment prepared by Kleinfelder, Inc. , and <br /> Environmental Risk Sciences, Inc. , was an assessment of the <br /> following potential exposure pathways: <br /> 1. Inhalation of volatile organic compounds (VOCs) from <br /> soil-gas at the North Country Squires property. <br /> 2 . Inhalation of VOCs from soil-gas at the Sharpe Site. <br /> 3 . Inhalation of VOCs from the Sharpe Site air <br /> strippers (North Balloon air stripper, South Balloon <br /> air stripper, and the proposed Central Area air <br /> stripper) . <br /> 4 . Inhalation of airborne arsenic from the North <br /> Country Squires soil. <br /> 5. Dermal contact with the North Country Squires soil <br /> containing arsenic and pesticides. <br /> The results of the field investigation indicated that <br /> pesticides were not detected in any soil samples, and thus were <br /> not considered further as an exposure pathway in t4ie-"Risk . <br /> Assessment. <br /> Arsenic was determined to be present in the North Country <br /> Squires soil at concentrations which appear to be typical of <br /> the area since they are not inconsistent with background <br /> samples collected about five miles north of the site. <br /> Therefore, inhalation of arsenic contaminated soil and dermal <br />
