NOTICE OF PUBLIC COMMENT PERIOD <br /> on a Land Use Restriction Agreement <br /> for Verner Parcels C and D <br /> The California Department of Health Services, Lyon Communities, no. <br /> and Verner Construction, Inc. are requesting public comment upon <br /> their agreement to restrict specified uses on land known as Verner <br /> Parcels C and D (the Property) . The Property was formerly known as <br /> Southern Pacific Railroad Parcels C and D. <br /> The Property is located in the City of Lathrop, San Joaquin County. <br /> The Property is located west of the Sharpe Army Depot, Bout of <br /> Squires Road, and east of Harlan Road. <br /> Groundwater contamination from Sharpe Army Depot has migrated <br /> offsite and is under portions of the Property. Lyon Communit Les, <br /> Inc. intends to construct a portion of a residential development <br /> known as Country Squires on the Property. To ensure that future <br /> residents of the Property are not exposed to contamin ted <br /> groundwater, the agreement will restrict the following uses of the <br /> Property: <br /> 1) No owner or occupant of this Property shall extract, utili e, <br /> consume or permit to be extracted any water from below the <br /> surfaces of the. ground without 'prior approval from the local <br /> Health District and the Department of Health Services. <br /> 2) All water utilized within the Property for any purpose shall <br /> be obtained from a municipal water source, unless approval <br /> from the local Health District and the Department of He lth <br /> services is obtained. <br /> 3) Prior to construction on the Property, all existing domestic <br /> and irrigation supply wells shall be abandoned pursuant to all <br /> applicable state and local regulations. However, groundwater <br /> wells, extraction systems, and associated equipment used for <br /> monitoring or other purposes by the Sharpe Army Depot, or is <br /> agents or successors, shall remain intact. <br /> A copy of the agreement is available for public review at the <br /> San Joaquin County Building Inspection <br /> and Planning <br /> 1810 E.
