DDRW-Sharpe CAS210020832 <br /> Hazardous Waste Facility Permit <br /> The owner and/or operator shall retain on-site, a <br /> current waste analyses plan describing how and when <br /> wastes or treatment residues will be tested to comply <br /> with the land disposal restriction regulations. <br /> F. Permit Actions <br /> This permit may be modified, revoked and reissued, or <br /> terminated for cause. The filing of a request by the <br /> owner and/or operator for a permit modification, <br /> revocation and reissuance, or termination or a <br /> notification of anticipated noncompliance or planned <br /> changes (except as provided in Cal. Code of Regs. , <br /> Title 22 , Section 66270 . 42 (a) ) , does not stay any <br /> permit condition. Except as provided in Cal. Code of <br /> Regs. , Title 22 , Section 66270.42 (a) , a new facility <br /> permit condition or a modification of an existing <br /> facility permit condition shall become effective on the <br /> date specified in the Department's written notice of <br /> approval of the permit modification, pursuant to <br /> Cal. Code of Regs. , Title 22 , Sections 66270 . 42 and/or <br /> 66271. 14 . <br /> G. Need to Halt or Reduce Activity <br /> It shall not be a defense for the owner and/or operator <br /> in an enforcement action that it would have been <br /> necessary to halt or reduce the permitted activity in <br /> order to maintain compliance with the conditions of <br /> this permit. <br /> H. Severability <br /> The provisions of this permit are severable, and if any <br /> provision of this permit or the application of any <br /> provision of this permit to any circumstance is held <br /> invalid, the application of such provision to other <br /> circumstances and the remainder of this permit shall <br /> not be affected thereby. <br /> I. Permit Expiration <br /> In accordance with Cal. Code of Regs. , Title 22 , <br /> Section 66270. 51, this permit and all conditions <br /> therein will remain in effect beyond the permit <br /> expiration or termination date, until the effective <br /> date of a new permit, if the owner or operator has <br /> submitted a timely and complete application (both Part <br /> • A and Part B) for a new permit and, through no fault of <br /> -4- <br />
