" "If the Director or authorized representative <br /> has a security clearance, they will be allowed entry <br /> into all areas, but will still be prevented from <br /> photographing anything within a restricted area. " <br /> Response: Permit Condition II.H. 8 .d will remain as written. If <br /> . corrective measures have to be taken in a restricted <br /> area to remediate the area and photographing the <br /> restricted area is necessary as part of the corrective <br /> measures, then the Environmental Protection Agency (EPA) <br /> has the authority to take photographs. This authority <br /> is granted to the EPA under 40 CFR Part 270. 32 (b) (2) . <br /> Comment: Section V.B. 3 - Disagree with statement the way it is <br /> written. Insert the following clause after the word <br /> "corrective actions" : " . . .not related to any matter <br /> addressed under the Federal Facility Agreement (FFA) <br /> and. . . " <br /> Response: The clause "not related to any matter addressed under <br /> the Federal Facility Agreement (FFA) and. . . " has been <br /> added to Permit Condition V.B. 3 after the words <br /> "corrective actions. " <br /> Questions: Is each agency (State and Federal) issuing separate <br /> permits? Who will have the final authority over the <br /> facility? <br /> Response: The EPA and Department of Toxic Substances Control <br /> (DISC) will be issuing separate permits for <br /> DDRW-Sharpe. Separate permits are necessary because DTSC <br /> is not authorized to implement the federal program <br /> (RCRA) . DTSC and EPA will have shared authority of <br /> DDRW-Sharpe. DTSC will enforce State laws and <br /> regulations and the EPA will enforce federal laws and <br /> Printed on Recycled Paper <br />
