f 1.7 "EPA" shall mean the United States Environmental Protect inn Agency', its successors and assigns, and its duly authorized representatives, which may include its employees, agents, and contractors, as necessary. EPA Region IX is included within this definition. 1.8 "Feasibility Study" or "FS" shall mean the study(ies) (including any study for an operable unit) which fully evaluates and develops remedial action alternatives to prevent or mitigate the migration or the release of hazardous substances, pollutants, or contaminants at and from the Site. 1.9 "Force Majeure" shall mean any event arising from causes beyond the control of a Party that causes a delay in or prevents the performance of' any obligation under this Agreement, including, but not limited to, acts of God; fire; war; insurrection; civil disturbance; explosion; unanticipated break- age or accident to machinery, equipment, or lines of pipe despite reasonably diligent maintenance; adverse weather conditions that could not be reason- ably anticipated; unusual delay in transportation; restraint by court order or order of public authority; inability to obtain, at reasonable cost and after exercise of reasonable diligence, any necessary authorizations, appro- vals, permits, or licenses due to action or inaction of any governmental agency or authority other than SHAD; delays caused by compliance with appli- cable statutes or regulations governing contracting, procurement, or acqui- sition procedures, despite the exercise of reasonable diligence; and insufficient availability of appropriated funds, provided that SHAD shall have made timely request for such funds as part of the budgetary process as set forth in Section 34, Funding.
