STATEMENT OF FACTS AND DETERMINATIONS <br /> 4.0 For purposes of this Agreement, the following constitutes a suannary of <br /> the facts and determinations upon which this Agreement is based. None of <br /> the facts related herein shall be considered admissions by any Party. This <br /> Section shall not be used by any person related or unrelated to this <br /> Agreement for purposes other than determining the basis of this Agreement. <br /> 4.1 Facts: <br /> 4.1.1 The Department of the Army owns and operates Sharpe Army Depot, <br /> adjacent to the northern edge of the community of Lathrop, approximately <br /> seven miles south of the City of Stockton, California. <br /> 4.1.2 Surface water drainage is primarily to the South San Joaquin <br /> Irrigation District drainage canal which is a tributary to French Camp <br /> Slough and thence to the San Joaquin River and the San Joaquin/Sacramento <br /> Delta. The first water table occurs at six to ten feet beneath the Depot. <br /> Groundwater flow is generally to the northwest. <br /> 4.1.3 The beneficial uses of the Delta, San Joaquin River, and French <br /> Camp Slough include domestic, industrial , and agricultural supply; <br /> recreation; esthetic enjoyment; and preservation and enhancement of fish, <br /> -8- <br />
