D. Waste Analysis Plan - Land Disposal Restrictions (LDR) <br /> • 1. Determine if waste is a LDR waste by: <br /> a. Testing of waste. <br /> b. Knowledge of waste. <br /> 2. If determination is based on knowledge, include all supporting data <br /> used to make the determination in the generator file along with the manifest. <br /> 3. If waste characteristics are unknown, the waste shall be tested or an <br /> extraction must be performed using the test method described in 40 CFR 268, <br /> Appendix I, Toxicity Characteristics Leaching Procedure (TCLP) . <br /> 4. If the determination is made that waste is LDR waste and it exceeds <br /> applicable treatment standards (40 CFR 268, Subpart D) , then LDR notification <br /> is required. The notice shall include the following information: <br /> (i) EPA Hazardous Waste Number; <br /> (ii) The corresponding treatment standard (CFR 40 268, Subpart D) ; <br /> (iii) The manifest number associated with the shipment of waste; and <br /> (iv) Waste analysis, where available. <br /> 5. If the determination is made that the waste is not a LDR waste, and <br /> that the waste can be land disposed without further treatment, a notice and <br /> certification stating that the waste meets applicable treatment standard must <br /> accompany shipment. The notice must include the following information: <br /> • (i) EPA Hazardous Waste Number; <br /> (ii) The corresponding treatment standard; <br /> (iii) The manifest number associated with the shipment of waste; <br /> (iv) Waste analysis data, where applicable; and <br /> (v) The certification must be signed by an authorized representative <br /> and must state the following: <br /> I certify under penalty of law that I personally have examined and am <br /> familiar with the waste through analysis and testing or through knowledge of <br /> the waste to support this certification that the waste complies with the <br /> treatment standards specified in 40 CFR Part 268 Subpart D. I believe that <br /> the information I submitted is true, accurate and complete. I am aware that <br /> there are significant penalties for submitting a false certification, <br /> including the possibility of a fine and imprisonment. <br /> 6.
