D. Waste Analysis Plan - Land Disposal Restrictions (LDR) • 1. Determine if waste is a LDR waste by: a. Testing of waste. b. Knowledge of waste. 2. If determination is based on knowledge, include all supporting data used to make the determination in the generator file along with the manifest. 3. If waste characteristics are unknown, the waste shall be tested or an extraction must be performed using the test method described in 40 CFR 268, Appendix I, Toxicity Characteristics Leaching Procedure (TCLP) . 4. If the determination is made that waste is LDR waste and it exceeds applicable treatment standards (40 CFR 268, Subpart D) , then LDR notification is required. The notice shall include the following information: (i) EPA Hazardous Waste Number; (ii) The corresponding treatment standard (CFR 40 268, Subpart D) ; (iii) The manifest number associated with the shipment of waste; and (iv) Waste analysis, where available. 5. If the determination is made that the waste is not a LDR waste, and that the waste can be land disposed without further treatment, a notice and certification stating that the waste meets applicable treatment standard must accompany shipment. The notice must include the following information: • (i) EPA Hazardous Waste Number; (ii) The corresponding treatment standard; (iii) The manifest number associated with the shipment of waste; (iv) Waste analysis data, where applicable; and (v) The certification must be signed by an authorized representative and must state the following: I certify under penalty of law that I personally have examined and am familiar with the waste through analysis and testing or through knowledge of the waste to support this certification that the waste complies with the treatment standards specified in 40 CFR Part 268 Subpart D. I believe that the information I submitted is true, accurate and complete. I am aware that there are significant penalties for submitting a false certification, including the possibility of a fine and imprisonment. 6. Sample Typical Land Disposal Notification follows: V-13 •
