Cherokee, Stockton Program: HW SUMMARY OF VIOLATIONS CLASS I,CLASS II,or MINOR-Notice to Comply) This is a report of the Routine Hazardous Waste (HW) inspection conducted at the referenced facility by San Joaquin County Environmental Health Department (EHD). A checklist was left on site for the generator due to time restrain. This is the final inspection report. The facility is under new ownership, and is categorized as a small quantity generator generating <5 tons of HW per year. The following are Minor Violations - Notice to Comply observed on site: #8,14,52. 8. No EPA number. -- A generator shall not store, dispose of, transport or offer for transportation HW without having received an active EPA number. * Submit an active EPA number to EHD. A copy of the EPA number application form has been supplied during this inspection. 14. No spill control or decontamination equipment. -- Facility shall be equipped with portable fire extinguishers, fire control equipment, spill control equipment, and decontamination equipment for release of HW. * Immediately provide spill control and decontamination equipment, and submit evidence of correction to EHD. 52. No spill control equipment was listed on the posted Modified Contingency Plan. -- Facilities are required to post a properly completed Modified Contingency Plan at all times. * Complete the Modified Contingency Plan and posted it by a telephone. Submit evidence of correction to EHD by October 1, 2010. NOTES (The following are not violations) -- 20. Observed Antifreeze container without complete HW label. All HW containers must be labeled with the following minimum information: 1) Generator name and address, 3) Accumulation start date, 4) Content, 5) Physical state, 6) Hazardous Property. Generator completed information on the HW label on site. Additional blank HW labels and HW labelling information has been provided. -- 23. Observed container of drained used oil and fuel filters not closed in a manner that will prevent release of content if the container is lying on its side. Observed generator putting on the band on the lid of the container. Discrepancy corrected on site. ALL EHD STAFF TIME ASSOCIATED WITH FAILING TO COMPLY BY THE ABOVE NOTED DATES WILL BE BILLED AT THE CURRENT HOURLY RATE($122).
