A cargo tank or oil tank <br /> must be attended by a qualified person at all times when it is being loaded. The <br /> person who is responsible for loading the aboveground tank is also responsible <br /> for ensuring that it is so attended. The qualified person must remain in <br /> attendance during the loading and unloading throughout the process, being alert <br /> and within 25 feet of the cargo tanker. The qualified person must have an <br /> unconstructive view of the cargo tank and delivery hoses to the maximum extent <br /> practicable during the loading or unloading operation. <br /> 5. Engine must be turned off. Unless the engine of a cargo tanker motor vehicle is <br /> to be used for the operation of a pump, oil products may not be loaded into, or <br /> on, or unloaded from any cargo tanker motor vehicle while the engine is running. <br /> 6. Tank and tanker overfill controls are in place and used for all oil product <br /> transfers. The facility's Tank Stick System provides protection against overfills <br /> during fueling and defueling operations. See 49 CFR 177.84 and 49 CFR <br /> 117.837 for tank Trucks specifications of the Department of Transportation <br /> regulations. <br /> Delivery procedures into the fuel tanks are established. Only drivers that are <br /> trained for unloading are authorized to make deliveries into FXI's site fuel oil product <br /> tank. Prior to delivering fuel to the site, personnel will either notify management, who <br /> shall confirm the types and amounts of fuel to be delivered to each oil products storage <br /> tank, and/or check the levels in the tank to assure sufficient space for the load to be <br /> delivered. <br /> The facility uses a tank gauge system to identify the fluid level of the <br /> aboveground tank in feet and inches. Delivery personnel shall check the tank to insure <br /> that their fuel delivery will sufficiently fill the oil product container and not exceed 90% of <br /> the tank's capacity. <br /> Warning signs, if appropriate or required, are posted at the facility alerting drivers <br /> to ensure that all connections are completely disconnected and secured prior from <br /> departing the facility. The driver will examine the valves, hoses, connections, fittings, <br /> and lowermost drain and outlets of the vehicle for leakage prior to loading, unloading or <br /> departure.
