Deny Variance Application No. VR-92-6 based upon the inability to make any of the thr e <br /> required Findings. <br /> FINDINGS <br /> 1. Because of the special circumstances applicable to the property, including size, sha e, <br /> topography, location, or surroundings, the strict application of the zoning regulation deprives the <br /> property of privileges enjoyed by other property in the vicinity and under identical zoning <br /> classification. <br /> • This Finding cannot be made because there are no special circumstances applica 'le <br /> to the property; its shape, size, and topography are essentially the same as of er <br /> properties In the vicinity with the same zoning designation. <br /> 2. The granting of the Variance will not constitute a grant of special privileges inconsistent with e <br /> limitations upon other properties in the vicinity and zone in which the property is situated. <br /> • This Finding cannot be made because the granting of the Variance will allow furt er <br /> subdivision of the property and the construction of an additional residence on he <br /> property, neither of which are permitted for owners of other properties In the vicl Ity <br /> with the same zoning designation. <br /> 3. The Variance will not authorize a use or activity which is not otherwise expressly authorized by <br /> the zone regulation governing the parcel of property. <br /> • This Finding cannot be made because the granting of the Variance could result In he <br /> construction of a second single-family residence on the 70-acre site. The site's G- <br /> 40 zone designation permits only one single-family residence per parcel. <br /> PROJECT DESCRIPTION <br /> The applicant is seeking a Variance application to decrease the minimum required parcel size in theG- <br /> 40 zone from 40 acres to 30 acres. The underlying project,which has not been submitted pending a ion <br /> on the Variance application, is expected to be a Minor Subdivision application to create a 30-acre parcel <br /> and a 40-acre parcel from the existing 70-acre parcel. <br /> The applicant is proposing to provide the following on-site services to the parcel that would result f om <br /> the project: private wells, individual septic systems, and on-site storm water retention ponds. <br />
