AMENDED CONDITIONS OF APPROVAL GX-90-5 PAGE THREE d. The final average elevation on Site B shall be no less than 46. 9 feet. e. All private roads involved in the excavation shall be maintained so as to control the creation of dust. f. Excavation operations shall not be carried out during hA hours from 9 : 00 p.m. through 5 : 00 a.m. g. Any night lighting established on the property shall be arranged and controlled to not illumina':e public rights- f-way or adjacent properties. h. A written notification of the work schedule shall be provi ed to the County by the applicant prior to any grading or excavation. The excavation and rehabilitation shall be completed by August 13 , 1992 . If the excavation does rot commence within 18 months after the date of approval, the permit is terminated. i. To ensure that the excavation is completed in conformance w th the approved permit, the applicant shall secure a performa ce bond or other financial security sufficient to cover the cost of rehabilitation of the site for agricultural use. The form of the bond or other financial security shall be found acceptable by County Counsel. As an alternative, the operator shall stockpile on the property all material to be remo ed from the site pending acceptance of the certification of compliance by the Zoning Administrator. Stockpiled mater al shall be set back at least 25-feet from any property line j . At the completion of the grading, the applicant shall have a registered civil engineer or licensed land surveyor compre the excavation ' s final elevations with the approved perm t. The engineer or surveyor shall submit a certified, writ en finding to the Planning Division which states and docume is the compliance or non-compliance of the excavation with the approved permit.
