Brookhurst St. <br /> Anaheim, CA 92903 SEP 2 <br /> ENVIF?ONMENTAL HEALTH <br /> Re: Chapin Brothers Shell �' F�M�T�5ElV10� <br /> 1766 Monte Diablo Ave. <br /> Stockton, CA 95203 <br /> Dear Mr. Turner: <br /> We appreciate your letter dated September 16, 1991 alerting us to the local <br /> underground storage cleanup fund workshop. We have received literature from the <br /> Sacramento and San Diego meetings in addition to material from the local public <br /> health agency. <br /> We have also been notified that the San Joaquin Public Health Services <br /> Environmental Health Division's local program for the oversight of assessment and <br /> clean up activities at contaminated underground tank sites has identified you <br /> (Shell Oil) as an additional responsible party, <br /> Furthermore, it is our understanding that a copy of the underground tank program <br /> official inspection report from the San Joaquin Health District dated September 9, <br /> 1991 also cited the Shell Oil Co. for a major violation of improper tank <br /> abandonment. It is our position that the removal of the tanks is a matter of <br /> mutual concern. <br /> Documents have been provided to the fact that of the four gasoline storage tanks <br /> on site only three were sold to Chapin Brothers Inc. Thus, Shell Oil owns one of <br /> the underground tanks at this said site ( 1766 Monte Diablo). This fact was <br /> demonstrated by the itemized list of the sale of property and equipment executed <br /> at the time Shell Oil lost the master lease from the previous owner (Mr, Tom <br /> Blanchard of Aptos, California). <br /> As to the matter of the schedule for the ranking and payment of claims submitted <br /> to the State of California, we are aware that the eligibility of a small business <br /> owner and operator has a ranking of category B while the Shell Oil Co. would have <br /> -a ranking of category D.
