Charlton Avenue Pl RNIIT/SERVICES <br /> Stockton, CA 95203 <br /> LEAD AGENCY STATUS AND DIRECTIVES FOR UNAUTHORIZED RELEASE CASE <br /> NO. 390577, CHAPIN BROTHERS INC., 1766 MONTE DIABLO AVE., STOCKTON, <br /> SAN JOAQUIN COUNTY <br /> In a letter dated 21 May 2009, the San Joaquin County Environmental Health Department <br /> referred the lead agency for the above case to the Regional Water Quality Control Board <br /> (Regional Water Board). Upon review of the technical data contained in our file and on the <br /> State's GeoTracker database system, as well as all recent correspondence, staff has <br /> determined the impacts to the soil and groundwater beneath your site continue to be elevated <br /> well in excess of both human health and safety and water quality criteria established to ensure <br /> protection of same. As such additional remedial efforts clearly need to be conducted. In <br /> addition, as per your 21 January 2009 letter, a review by State Water Resources Control Board <br /> (State Water Board) Underground Storage Tanks Cleanup Fund staff has also concluded the <br /> need to continue remediation and monitoring the identified impacts, while they consider your <br /> closure appeal petition. In that the State Board's appeal process may take several months to <br /> years to resolve and the identified contamination that you are responsible for continues to <br /> significantly impact waters of the state and threaten human health and safety, corrective action <br /> work at your site is not to stop. <br /> Therefore, you are to: <br /> 1. Begin monitoring all wells semi-annually per State Water Board Resolution No. 2009- <br /> 0042, starting with the third quarter of 2009, and to continue until directed otherwise by <br /> staff. You are to monitor during the first and third quarter of each year, with reports due <br /> the 30th day of the month following the reporting quarter. <br /> 2. Immediately restart the existing groundwater pump and treatment system during the third <br /> quarter of 2009, and to run said treatment system until such time that staff directs its <br /> shutdown. <br /> Your next monitoring report is due 30 October 2009 and is to include a section discussing the <br /> re-start of the remedial system. Pending staff receipt of the monitoring reports (hard copy and <br /> GeoTracker), the data will be reviewed for further adjustments to this directive letter, which may <br /> include stopping the monitoring, increasing to quarterly monitoring or decreasing to annual <br /> monitoring, or changing the analytical suite of chemicals.
