• It is troubling to realize that the above action and with the threat of a <br /> suspension, I am now facing fines and Administrative Civil Liabilities. <br /> The failure of a contractional agreement with the UST fund to repay our <br /> costs within sixty 60 days of receipt has caused a living nightmare. I <br /> remain committed to comply with all regulatory directives as possible. <br /> • I am now in the process of a second Underground Tank Closure Appeal <br /> however; this action is not intended to escape our responsibility as a tank <br /> owner. <br /> • As I consider the merits of continuing with the regulator to advance this <br /> process Chapin Bros. has obtained a draft work plan from three <br /> consultants 1. Source Group, Inc. 2. Closure Solutions, Inc 3. AGE of <br /> Stockton. All three proposals require additional costs exceeding <br /> $200,000. (dollars)and several years to complete. Even with this <br /> additional remediation effort, it is the consultants' opinion; Chapin Bros <br /> will never reach the goals presently in place. It is now time to ask, "What <br /> is enough"? <br /> This letter attempts to outline my general concerns from a Tank Owners perspective. <br /> Perhaps not specific to the technical issues raised but certainly enough to define our <br /> frustration level. Chapin Bros case has been open since 1995. A review of UST cleanup <br /> cases such as ours (class B#557) should insure a high priority and receive appropriate <br /> regulatory attention. <br /> I appreciate the Board and staffs attempt to correct many of my concerns, however, I am <br /> not very hopeful even if the Regional Board and Local Agency supports the proposed <br /> Resolution; the fact remains, nothing in the past action was fair and reasonable. <br /> Respectively Submitted, <br /> ej <br /> Russell F.
