Box 445, <br /> Escalon, California 95206, which acquired title to the <br /> Property on June 1, 2000 in the name of Toledo Holdings, <br /> Inc . from KOK Realty. <br /> The entity which is now deemed the active and primary <br /> Responsible Party for the continuation of the investigation <br /> into and the remediation of the Property as a result of the <br /> contamination caused by the leaking Tank is certified to be <br /> C&R, which assumed the obligation and responsibility <br /> pursuant to the Environmental Indemnity Agreement, dated as <br /> of May 30, 2000, between KOK Realty, as Seller, and C&R, as <br /> Buyer. <br /> KOK Realty further hereby certifies that, to the best <br /> of its knowledge and belief, there are no lienholders having <br /> an interest in the Property at this time and that there are <br /> no Record Title Owners and/or Responsible Parties with <br /> respect to the Property other than CBP Resources, KOK Realty <br /> and C&R. These three (3) named Record Title Owners and <br /> Responsible Parties are the only named entities which need <br /> be given notice prior to the Environmental Health Division <br /> considering any cleanup or closure proposals with respect to <br /> the Property submitted by or on behalf of the primary and <br /> active Responsible Party, C&R. <br /> The foregoing is certified to by an officer of and an <br /> attorney for KOK Realty Corp. who has knowledge of the <br /> facts. <br /> KOK REALTY CORP. <br /> By /IA"'w' <br /> Sheldon Basch <br /> Asst .
