To: David Irey,Deputy District Attorney San Joaquin Environmental Prosecution Unit From: Donna Heran,Director Environmental Health epartment Date: October 28,2002 Re: Super Stop Market 515 W. 1 V Street,Tracy L SUMMARY On April 17, 2002, the referenced facility was mailed a letter stating that they needed to perform their annual monitoring certification, line leak detector test and line tightness test by May, 18, 2002. (Attachment 1)The required tests were not performed. On July 2, 2002, Dennis Catanyag, REHS, performed a routine underground storage tank (UST) inspection. (Attachment 2) At this time,the facility was issued an inspection report stating that they must perform their routine annual monitoring certification, line leak detector test and line tightness test by August 2, 2002. The UST inspection report also informed them that the following documents needed to be submitted: Current state form B, Certification of Financial Responsibility, and a Letter from the Chief Financial Officer. These tests were not performed and the requested documents were not submitted. In addition, on July 2, 2002, Michelle Sterni Le, REHS performed a routine hazardous waste generator inspection. An inspection report was issued. (Attachment 3) The owner/operator was told to submit the Certificate of Return to Compliance to this office by August 10,2002. This document has not been submitted. On August 16, 2002, the owner was sent a certified follow up letter (Attachment 4) to the July 2, 2002 underground storage tank and hazardous waste inspections. The underground storage tank inspection follow up letter stated that the annual monitoring certification, line leak detector test and line tightness test had not been performed and that they must perform these tests by September 20, 2002, or legal action may occur. As of this date, these tests have not been performed. The hazardous waste inspection follow up letter stated that this office had not received the requested facility EPA ID number and that it must be submitted to this office by September 20,2002,or legal action may occur.
