We are in receipt of a letter dated January 6, 1999, denying closure of the case and
requesting additional investigation work, and, consequently,we are re-activating this petition.
1 am hereby requesting copy of your complete record in this case. To ensure timely resolution of
this matter, I request that within 20 days (in accordance with State Board Resolution No. 88-23,
subdivision 3) you provide me with an up-to-date copy of your case file, a list of any interested
parties and adjacent property owners, and a description of the issues at this site which, in your
opinion, preclude closure of this case. Please include all relevant assertions and associated
supporting technical facts to be presented by you in opposition to site closure including: 1) your
complete conceptual site model identifying environmental characteristics and site conditions and
a listing of receptors; and 2) any pertinent data and interpretation regarding the Tri-Valley
Growers canning facility located adjacent and south of the site. Please also include details of any
direction the Central Valley Regional Water Quality Control Board has supplied to you regarding
management of this residential case.
I understand that groundwater at the subject residential property site has been monitored and the
last four groundwater monitoring event results have indicated non-detectable concentrations of
BTEX compounds (<0.5 ppb) and repeated sampling and analyses for MTBE have likewise been
non-detect(<5.0 ppb). Please confirm or correct these understandings.
California Environmental Protection Agency
01 Recycled Paper
