The scope of work for <br /> the investigation was outlined in HLA's work plan, and work plan addendum, dated August 5, 1997 and <br /> January 14, 1998, respectively. This letter also presents written notice of the field work that has been <br /> scheduled for March 26, 1998. <br /> On January 15, 1998, a telephone conversation took place between Ms. Mary Meays of the PHS/EHD and <br /> Mr. Gary D. Haeck of HLA regarding the benefits of installing the proposed monitoring well (MW-7) at the <br /> former underground storage tank(UST) location (see attached plate). Ms. Meays indicated that she had <br /> discussed with you, and you had concurred, that it was not necessary to install and then destroy shortly <br /> afterwards the additional monitoring well (after site closure). She indicated that PHS/EHD felt that the field <br /> and analytical data from the Hydropunch boring would provide sufficient information to show that free <br /> product is not present and to calculate the mass of hydrocarbons present. HLA agreed that the well was not <br /> necessary and indicated that after conferring with Tri Valley Growers (TVG), HLA would call Ms. Meays <br /> back to confirm this agreement. <br /> On January 16, 1998, HLA called Ms. Meays and confirmed TVG's agreement with PHS/EHD that the well <br /> was not necessary and the required data would be collected from the Hydropunch boring. On January 22, <br /> 1998, Ms. Meays forwarded the attached memo indicating that PHS/EHD would formally document the <br /> understanding and respond to the work plan addendum. To date no further correspondence had been <br /> received. HLA called Ms. Meays on March 18, 1998 and learned that she was no longer a staff member at <br /> PHS/EHD. <br /> This letter provides confirmation of the agreement and that all work will be performed consistent with <br /> HLA's work plan, work plan addendum, and the agreement reached with the PHS/EHD. Field activities are <br /> scheduled for March 26, 1998.
