Speedy Mart, Stockton - 2 - 16 May 2000 <br /> 3. For the second quarter of 2000, complete Quarterly Groundwater Monitoring and Sampling of <br /> the four on-site monitoring wells, and provide a report of quarterly groundwater monitoring and <br /> sampling activities and analytical results by 26 June 2000. Thereafter, submit quarterly <br /> monitoring reports by the last day of the mamth following the end of the calendar quarter <br /> (31 January, 30 April, 31 July' and 31 October). All wells must be sampled and analyzed for <br /> TPHg and BTEX by EPA Methods 8015/8021 or 8260B, and for all fuel oxygenates, ethanol, <br /> methanol, 1,2-DCA, and EDB by EPA Method 8260B. <br /> 4. Submit a workplan by 26 June 2000 to define the vertical and lateral extent of soil and <br /> groundwater contamination both on-site and oft-site. <br /> The plan for an alternate water supply, receptor sun•ey. quarterly monitoring, and workplan to define the <br /> extent of contaminants are all technical reports as dzscribed in Section 13267 of the California Water <br /> Code, which states, in part: <br /> (b)(1)In conducting an investigation specified in subdivision (a), the regional board may <br /> require anyperson who has discharged, discharges, or is suspected of discharging, or who proposes <br /> to discharge waste within its region...shall furnish, under penalty of perju?y, technical or monitoring <br /> reports which the regional board requires. The burden, including costs, of these reports shall bear a <br /> reasonable relationship to the need for the report and the benefits to be obtained from the reports. " <br /> Failure to submit the requested technical reports could lead to fines authorized by Section 13268 of the <br /> Water Code, which states: <br /> (q)Any person failing or refusing to furnish technical or monitoring program reports.as <br /> required by subdivision (b) of Section,13267...is guilty of a misdemeanor and may be liable civilly in <br /> accordance with.subdivision (b): <br /> (b)(1) Civil liability may be administratively imposed by a regional board in accordance with <br /> Article 2.5(commencing with Section 13323,) of chapter 5 far a violation of subdivision (a) in an <br /> amount which shall not exceed one thousand dollars ($1,000)for each day in which the violation <br /> occurs. <br /> All work must be performed according to the enclosed Tri-Regional Recommendations for Preliminary <br /> Investigation and Evaluation of Underground Storage Tank Sites, and permits required by State and <br /> Local agencies. You must submit all reports to the San Joaquin County Environmental Health <br /> Division and the Regional Board. <br />
