HWY 99 <br /> Lodi, CA 95240 <br /> Response to Responsible Party (RP) request for supporting documentation related to <br /> LOP site specific oversight charges incurred 7195 to I2/95. <br /> I have recently completed the response to Terry Tarditi's formal request regarding SJCPHS/EHD <br /> LOP site specific charges incurred 7/95 to 12195 and respectfully submit to you the enclosed <br /> narrative with date, name, account code, hours and continents for your review. It is my <br /> understanding that you will forward this information to the RP. <br /> As I indicated to you during our July 8, 1996 telephone conversation the responsible party has <br /> on several occasions failed to comply with corrective action regulations including overexcavation <br /> without LOP approval or supervision and is currently out of compliance with regard to quarterly <br /> groundwater monitoring data requirements. In addition the RP has failed to adequately define <br /> the full lateral and vertical extent of contaminant distribution in a timely manner. As noted in <br /> the formal response many hours of oversight are the result of consultant telephone consultations <br /> with this agency. If the RP chooses to do so, he may elect to limit his consultants contact with <br /> this agency and attempt to reduce the number of corrective action noncompliance issues in the <br /> future in order to more effectively control costs. <br /> In an attempt to maintain compliance at this site and avoid jeopardizing the RP's reimbursement <br /> SJCPHS/EHD will be directing the RP to submit all groundwater monitoring data available to <br /> date, continue assessment and groundwater monitoring in a formalized format. In the event the <br /> RP fails to respond to documented directives in the future, appropriate enforcement actions may <br /> be required. <br /> Should you have questions or comments regarding this correspondence please contact me at(209) <br /> 468-0342. <br />
