On 11 February 2004 staff visited the <br /> wastewater treatment system and observed wastewater pooled on the ground surface. Small berms had <br /> been constructed in an attempt to contain the wastewater. Discharge Prohibition No. A.3 states, <br /> "Surfacing or spillage of wastewater at the treatment system or in the seepage pits areas is prohibited." <br /> Photographs of site conditions on 11 February 2004 are attached to this letter. <br /> In addition, Arbor MHP failed to report the surface spill as required by the WDRs. WDRs Provision F.4 <br /> requires compliance with the Standard Provisions and Reporting Requirements, a copy of which is <br /> enclosed. Standard Provision B.1 requires noncompliance be verbally reported to the Regional Board <br /> immediately and a written report submitted within two weeks. The failure of Arbor MHP to report the <br /> noncompliance is another violation of the WDRs. <br /> A review of self-monitoring reports indicates all seepage pits are constantly in use indicating inadequate <br /> disposal capacity exists. In a telephone conversation on 17 February 2004, you informed staff that 15 new <br /> seepage pits have been constructed and are now in use, alleviating the capacity problem. Arbor MHP <br /> should carefully manage the wastewater system to prevent discharge of solids that can result in plugging <br /> the new seepage pits. <br /> By 19 March 2004, Arbor MHP shall submit a report describing the spill (volume, duration, control <br /> measures), an assessment of the cause of the spill, how the waste was cleaned up, and a report describing <br /> how future spills will be prevented. Wastewater spills have been a recurring issue at Arbor MHP; further <br /> spills, or the failure to report such spills, may result in additional enforcement actions, which could <br /> include imposition of Administrative Civil Liabilities. <br /> California Environmental Protection Agency <br /> Co Recycled Paper <br /> The energy challenge facing California is real.
