zi ® ® <br /> li <br /> S� <br /> I. <br /> In 1989, the Legislatur adopted landmark legislation that requires hazardous waste <br /> generators consider source reduction as the preferred method of managing hazardous , <br /> waste. This law, proposed in Senate Bill (SB) 14 as the Hazardous Waste Source <br /> Reduction and Manag ment Review Act of 1989 (Act), promotes source reduction over <br /> recycling and treatment because it avoids the generation of hazardous wastes and its <br /> associated management liability. <br /> SB 14 applies to any gE nerator who, by site, routinely produces through ongoing processes <br /> and operations, more than 12,000 kilograms of hazardous waste in a calendar year, or <br /> more than 12 kilograms of extremely hazardous waste in a calendar year. Once captured <br /> by SB 14, a generator must prepare a Source Reduction Evaluation Review and Plan (Plan), _ <br /> -Plan Summary, Hazard us Waste Management Performance Report (Report), and Report <br /> Summary. The preparation of these documents guides the generator in looking for <br /> opportunities to implement source reduction measures. <br /> Small businesses, as defined in the Government Code, that are captured by SB 14 could <br /> choose to complete thE forms contained in any one of the Department's industry-specific <br /> "Waste Audit Studies" or "Hazardous Waste Minimization Checklist and Assessment <br /> Manuals" as their Source Reduction Evaluation Review and Plan. Small businesses could <br /> also choose to use their current Generator's Biennial Report as their Hazardous Waste <br /> Management Performa ce Report. A complete listing of"Waste Audit Studies" and <br /> "Hazardous Waste Minimization Checklist and Assessment Manuals" is located at the end <br /> of this document. <br /> The adoption of Senate Bill 1726, added by Statutes of 1992 as Chapter 853, broadens the <br /> applicability of SB 14 t include any generator who routinely generates more than 5,000 <br /> kilograms of specified categories of hazardous waste in a calendar year. The categories of <br /> hazardous waste incluc e RCRA hazardous waste for which a RCRA treatment standard has <br /> not yet been develope , non-RCRA solid hazardous wastes containing metals, and non- <br /> RCRA hazardous waste whose treatment standards are based on incineration, solvent <br /> extraction, or biologica treatment. Generators newly captured by SB 1726 must prepare a <br /> Compliance Checklist or a Source Reduction Evaluation Review and Plan by September 1, <br /> 1993 and every four ye ars thereafter. The Compliance Checklist is a simple, <br /> understandable method for the smaller quantity generator to comply with the requirements <br /> of the Act in an inexpe sive and convenient manner. The Compliance Checklist guides <br /> generators toward opportunities where source reduction measures can be applied. <br /> Small businesses also benefit from the adoption of SB 1726.
