San Joa uin Street <br />Stockton, CA 95201 <br />Dear Ms. Heran: <br />MAY 2 7 1994 <br />ENvPERMITLTH <br />/SERVICES <br />1 'S, 1994 <br />File: Environmental Protection <br />Stockton, CA <br />Health <br />A re ent telephone conversation with Eleanor Ratliff of <br />your staff has ndicated that the Railroad's extension outlined in <br />our letter of M�y 9 has been granted, except for Violations #5 and <br />#6. <br />At this time I would like to address both violations and <br />bring #5 and #6 to a close. <br />Violation #5 - Section 66262.34 (a), Article 3, Chapter 12, <br />Title 22, alifornia Code of Regulations: Hazardous waste (20 <br />yard bin) was stored on site more than 90 days without a <br />permit or ariance from the Department of Toxic Substances <br />Control. <br />Correction #5 - Within 10 days of receipt of this report, all <br />hazardous aste stored past 90 days shall be properly disposed <br />of. <br />As of 01'/14/94 the referenced 20 yard bin has been <br />properly (Imanifested, removed/transported and disposed <br />(attachmenit) from Union Pacific Railroad property. <br />Violation #6 - Section 66262.42 (b), Article 4, Chapter 12, <br />Title 22 alifornia Code of Regulations: The generator did <br />not send an Exception Report to the Department of Toxic <br />Substances Control within 45 days of the date the waste was <br />accepted b the initial transporter. <br />Correction#6 - Within 10 days of receipt of this report, <br />submit an �xception Report for manifest #981385347 - 38031. <br />On date, te Railroad will be submitting an Exception Report <br />for manife t #981385347 - 38031 (attachment). <br />
