California 95812-0806 <br />November 2007 <br />RTANT NOTICE: TIME SE <br />Control <br />RED <br />Arnold Schwarzenegger <br />Governor <br />The California Department of Totp <br />Substances Control (DTSC) records indicate that your facility has not submitted your Summary <br />Progress Report (SPR) by the tember 1, 2007 deadline as required under the California Health and Safety Code (HSC), <br />Division 20, Chapter 6.5, Article 1 1- 9, Hazardous Waste Source Reduction and Management Review Act of 1989 (SB 14). If your facility <br />is subject to SB 14, this letters ryes as a notice of noncompliance with the requirements of SB 14. Failure to comply may <br />subject you to formal enforcem nt action, including civil penalties of up to $1,000 for each day of violation. <br />Hazardous waste generators in Capifomia that annually produce 12,000 kilograms (26,400 pounds) or more of hazardous waste, or <br />12 kilograms (26.4 pounds) or more of extremely hazardous waste, are subject to the requirements of SB 14, pursuant to HSC <br />Section 25244.15. Generators of hazardous waste in excess of the threshold quantities are required to prepare a Source Reduction <br />Evaluation Review and Plan (Plan)i a Hazardous Waste Management Performance Report, and a Summary Progress Report (SPR) <br />every four years. Only the SPR must be submitted to DTSC by September 1 of the submittal year, which in this cycle, was <br />September 1, 2007. <br />DTSC records indicate that your facility, as identified by the U.S. Environmental Protection Agency (U.S. EPA) <br />ID # located in the address block on the reverse side of this letter, generated in excess of the threshold quantity of applicable <br />hazardous waste (which includes a ueous hazardous waste pre-treated and discharged) in 2006. There are a number of waste <br />streams that qualify for exemptions Under SB 14, and do not count toward the 12,000 kilogram threshold for SB 14 -applicable wastes. <br />Wastes which are exempt from SB 14 coverage include: wastes that are not routinely generated, asbestos, site cleanup wastes, motor <br />vehicle fluids, lead acid batteries, lighting wastes, and medical wastes. Please check your records to determine whether you generated <br />reportable quantities of SB 14 wastes. However, DTSC records do not provide sufficient data to allow us to confirm the applicability of <br />any exemption to your facility. <br />Your facility did not submit an SPR to DTSC on or before September 1, 2007. Generators subject to SB 14 must submit SPRs, <br />as required by HSC Section 25244119(b) (10). <br />In order to reduce your exposure to a formal enforcement action, please complete the response form on the reverse side of this <br />letter and return it to DTSC within ten days upon receipt of this letter.
