REQUIREMENTS FOR APPLICATION <br /> SD-94-26 <br /> (a) Existing Residence. There shall be no more than one (1) existing <br /> single-family dwelling on the property. <br /> (b) Owner Occupancy. The owner of the property shall occupy either the <br /> existing single-family dwelling or the proposed second unit dwelling <br /> for a period exceeding 90 days per year. <br /> (c) Number of Units. There shall be no more than one (1) second unit; <br /> dwelling per parcel. <br /> STANDARD REQUIREMENTS <br /> SD-94-26 <br /> The Ordinance Requirements listed below have been identified as <br /> pertinent to this project. Other Ordinance Requirements may also apply. <br /> Ordinance Requirements cannot be modified. <br /> (a) Size of Unit. The second unit dwelling shall conform to the <br /> following requirements: <br /> (1) Except as provided in Subsection (a) (2) , the second unit <br /> dwelling shall not exceed (1200) square feet of living area. <br /> (2) In areas zoned AG, AL, or AU, the second unit dwelling may <br /> exceed (1200) square feet of living area provided the existing <br /> dwelling is used as the second unit dwelling. <br /> (b) Setbacks. The second unit dwelling shall comply with all yard <br /> requirements for a main structure in the zone as well as the <br /> following requirements. <br /> (1) Except as provided in Subsection (b) (2) , the second unit <br /> dwelling shall not extend into the front yard area beyond the <br /> single family dwelling. <br /> (2) In areas zoned AG, AL or AU, the second unit dwelling may <br /> extend into the front yard area if not a mobile home. <br /> (c) Off-Street Parking. Off-street parking shall be provided as <br /> required by Chapter 9-1015. <br /> (d) Common Driveway. Except in agricultural zones, the second unit <br /> dwelling shall be accessed by a common driveway serving both the <br /> second unit dwelling and the existing or proposed single-family <br /> residence and having a single access point. <br />
