The EHD is aware of the current
economic situation with the CUF and the difficulties it imposes for responsible parties continuing
to investigate their sites.
Please be aware that the California Code of Regulations, Title 23, Section 2652 (copy enclosed)
requires owners of contaminated underground storage tank sites to report quarterly on the
status of their site to the lead regulatory agency overseeing the investigation. The report must
include an update on specific information and results of all corrective action (investigation)
which has occurred during the period. An item that must be discussed in each quarterly report
is future investigative actions and a time schedule for implementing the actions. You may
prepare this report yourself unless geologic or engineering interpretation is included which
would require that it be prepared by an appropriately registered professional.
Your request to only collect and analyze ground water samples from the monitoring wells and
submit a report once a year (annually) is not approved. You must submit a brief report on the
status and time schedule for work at the site each quarter.
Since you have a newly installed remediation system at the site it's effectiveness needs to be
evaluated. The EHD require that monitoring wells in the contaminated ground water plume be
sampled for the following constituents, by the listed EPA Method, and at the frequency noted
below:
• MW-1, 2, and 3 for TPHg, BTEX, MtBE and 1,2-DCA (EPA Method 8260B) twice a year
(biannual).
