I had informed you
that the Estate of Giambanco did not currently have cash
on hand , but that a petition for the sale of assets had
been drafted and would be heard by the court on March 2 ,
1994 . Further , that the Estate attorneys expect the
completion of sale of assets to take approximately 30 days
after court approval .
Yesterday , Pam called to tell me that in the
alternative the Estate could pay closure fees of $ 702 . 00
and submit a closure plan , instead of the active fees .
You said that this alternative would " buy time " . You
indicate that you would take fifteen days or so to review
the plan . Upon your approval , the Estate would have 90
days to close the tanks , and that , if necessary , the
Estate may seek an extension for an additional 90 days .
Mike , in our conversation you indicate that if the
Estate submits closure fees and closure plan that this
course of action would abate your intended course of
action to request district attorney enforcement . You
also , suggested that a closure plan may include a ^
provision for overexcavation of the soil during the tank ` 1
F: \TRN\ 19257\C\GIAMHANS .
