Representing the Peter Giambanco, Sr,Estate (Estate) <br /> were Steve Critzer of the law firm Gianell¢ Brew and Jeanne Zolezzi of the law firm Neumiller and <br /> Beardslee. Representing PHS/EHD were Doug Wilson and Pam Violett of the Underground Tank <br /> Program and Linda Turkatte of the Site Mitigation Program. <br /> The removal of the abandoned underground storage tanks at 4405 Pacific Avenue was the principal issue <br /> of discussion at the meeting. It was agreed that as an interim measurejany fuel product that may be <br /> remaining in the tanks will either be removed or confirmed to have already been removed within 30 days. <br /> The representatives of the Estate will request bids for the removal of the tanks, select the lowest bid and <br /> present this bid to the probate court for authorization to proceed within 60 days. The underground tanks <br /> will be removed as soon as the probate court authorizes the allocation of funds for this purpose. <br /> The representatives of the Estate may request an extension to begin investigative work at the Pacific <br /> Avenue site until after the underground tanks have been removed. <br /> Based on the availability of funds from the probate court, a time table with dates for the submittal of a <br /> workplan, the installation of soil borings/monitoring wells and the submittal of a report of findings will be <br /> compiled and submitted to PHS/EHDrA tim"abl�leged fermi ' <br /> �. f wt �� . <br /> It is understood that current resources for the investigation and cleanup of these sites may be limited. <br /> However, work at these sites must proceed at a reasonable rate and all sources of funding should be <br /> considered. In addition, the ongoing litigation involving this Estate should not cause any undue delays in <br /> the progress of the investigation and cleanup of the contamination at these sites. <br /> The State Water Resources Control Board must be notified prior to the closing of the Estate so that a <br /> final bill for oversight costs can be presented to the Estate for payment.
