Infurna : <br /> As you know , we represent the Estate of Peter Giambanco , Sr . <br /> The Estate is in the process of obtaining bids for investigative <br /> work your agency has requested in order to attempt to comply with <br /> your deadline of July 15 , 1993 , for submittal of a workplan . <br /> On June 28 , 1993 , we requested the bidding of environmental <br /> consultants to provide an addendum to their initial bids . The <br /> purpose of this request was to obtain consistency in the bid <br /> packages so that they can be compared against one another <br /> equally . Upon receipt of the bid addendums our office will <br /> present the bids to the Estate . I want to take a moment to <br /> explain how an estate works . <br /> Peter Giambanco , Jr . has been appointed the administrator of <br /> the Estate by the Stanislaus County Superior Court . As the <br /> administrator , Peter Jr . is responsible for the administration of <br /> the Estate . The purpose of the Estate is to wind up the debts of <br /> the decedent and then , if there are remaining assets , to <br /> distribute those assets in accordance with the terms of the <br /> decedent ' s Will . All of the actions taken by the Executor are <br /> subject to approval by the Probate Court . In essence , Peter Jr . <br /> presents proposed payments to creditors to the Probate Court <br /> which in turn authorizes the expenditures . The Estate of <br /> Giambanco has many creditors and distribution of the assets has <br /> not yet occurred . To retain one of the consultants , the bid <br /> ( presumably the lowest costing bid ) must be presented to the <br /> Probate Court before the Estate can award or contract for the <br /> consultant ' s services . <br /> Given the state of the initial bids ( without addendums ) we <br /> project that the cost should be in the range of $ 18 , 000 more -or- <br /> less . The Court must approve this expenditure before the Estate <br /> may contract with the consultant . We believe it is fair to warn <br /> Fr \TRN\19257\C\GIAMBAM2 .
