The letter <br /> is intended to be the Corrective Action and Prevention response required within 30 days of the receipt of <br /> a Notice of Violation (NOV) dated April 26, 2005 , and related to the recent shut-down of the associated <br /> groundwater treatment system. <br /> Bill Cook of Condor telephoned you on March 23 , 2005 to report that the system remained out of <br /> operation as described in the letter dated March 8, 2005 and would not be operated during the month of <br /> March. Guidance was requested on how to proceed with the required monthly sampling and reporting <br /> under these circumstances because no final discharge sample could be collected while the system was <br /> inoperative. Furthermore, the only sample from the month of March was collected on March 1 , in <br /> conjunction with the system shutdown. The sample was intended to confirm the results of the final <br /> discharge sampling conducted on February 16, 2005 and not as the final discharge sample for the month <br /> of March. Therefore, the sample collected on March I was not analyzed for pH. <br /> During the above referenced telephone conversation, you indicated that a monthly monitoring report <br /> would be required because the system was operating and discharging on March 1 and suggested that if <br /> the equipment could not be restarted and another sample collected (as the permit requires), then the <br /> report should be written with the sample data available. Condor proceeded as advised. <br /> Condor' s corrective action to mitigate the problem will be a change in standard operating procedure. All <br /> fmal discharge samples will be analyzed for pH in the future, regardless of the intended use of the data. <br /> I certify under penalty of law that this document and all attachments were prepared under my direction or <br /> supervision in accordance with a system designed to assure that qualified personnel properly gather and <br /> evaluate the information submitted.
