The letter
is intended to be the Corrective Action and Prevention response required within 30 days of the receipt of
a Notice of Violation (NOV) dated April 26, 2005 , and related to the recent shut-down of the associated
groundwater treatment system.
Bill Cook of Condor telephoned you on March 23 , 2005 to report that the system remained out of
operation as described in the letter dated March 8, 2005 and would not be operated during the month of
March. Guidance was requested on how to proceed with the required monthly sampling and reporting
under these circumstances because no final discharge sample could be collected while the system was
inoperative. Furthermore, the only sample from the month of March was collected on March 1 , in
conjunction with the system shutdown. The sample was intended to confirm the results of the final
discharge sampling conducted on February 16, 2005 and not as the final discharge sample for the month
of March. Therefore, the sample collected on March I was not analyzed for pH.
During the above referenced telephone conversation, you indicated that a monthly monitoring report
would be required because the system was operating and discharging on March 1 and suggested that if
the equipment could not be restarted and another sample collected (as the permit requires), then the
report should be written with the sample data available. Condor proceeded as advised.
Condor' s corrective action to mitigate the problem will be a change in standard operating procedure. All
fmal discharge samples will be analyzed for pH in the future, regardless of the intended use of the data.
I certify under penalty of law that this document and all attachments were prepared under my direction or
supervision in accordance with a system designed to assure that qualified personnel properly gather and
evaluate the information submitted.
