The United States Environmental Protection Agency first issued the Oil Pollution <br /> Prevention Regulation, also known as the Spill Prevention, Control, and <br /> Countermeasure (SPCC) regulation, under the Clean Water Act (CWA) in 1973. <br /> It established requirements, including an SPCC Plan, for facilities to prevent oil <br /> spills from reaching navigable waters of the U.S. The SPCC requirements apply <br /> to facilities that meet the following criteria: <br /> • Could reasonably be expected to discharge oil in harmful quantities into <br /> navigable waters of the United States; and <br /> • Have (1) a total aboveground oil storage capacity greater than or equal to <br /> 1,320 gallons, or (2) a total underground oil storage capacity of greater than or <br /> equal to 42,000 gallons. <br /> Facility SPCC Plans address the following three major areas: <br /> • Operating procedures that prevent oil spills; <br /> • Control measures installed to prevent a spill from reaching <br /> navigable waters; and <br /> • Countermeasures to contain, clean up, and mitigate the effects of an oil spill <br /> that reaches navigable waters. <br /> Definitions <br /> Alteration <br /> Any work on a container involving cutting,burning, welding, or heating <br /> operations that changes the physical dimensions or configuration <br /> of the container. <br /> Bulk Storage Container <br /> Any container used to store oil. These containers are used for purposes <br /> including,but not limited to, the storage of oil prior to use, while being used, or <br /> prior to further distribution in commerce. Oil-filled electrical, operating, or <br /> manufacturing equipment is not included in the definition of a bulk storage <br /> container. <br /> Discharge <br /> Includes, but is not limited to, any spilling, leaking, pumping, pouring, emitting, <br /> emptying, or dumping of oil,but excludes discharges in compliance with a <br /> permit under §402 of the CWA; discharges resulting from circumstances <br /> identified, reviewed, and made a part of the public record with respect to a <br /> permit issued or modified under §402 of the CWA, and subject to a condition in <br /> such permit; or continuous or anticipated intermittent discharges from a point <br />
