The United States Environmental Protection Agency first issued the Oil Pollution
Prevention Regulation, also known as the Spill Prevention, Control, and
Countermeasure (SPCC) regulation, under the Clean Water Act (CWA) in 1973.
It established requirements, including an SPCC Plan, for facilities to prevent oil
spills from reaching navigable waters of the U.S. The SPCC requirements apply
to facilities that meet the following criteria:
• Could reasonably be expected to discharge oil in harmful quantities into
navigable waters of the United States; and
• Have (1) a total aboveground oil storage capacity greater than or equal to
1,320 gallons, or (2) a total underground oil storage capacity of greater than or
equal to 42,000 gallons.
Facility SPCC Plans address the following three major areas:
• Operating procedures that prevent oil spills;
• Control measures installed to prevent a spill from reaching
navigable waters; and
• Countermeasures to contain, clean up, and mitigate the effects of an oil spill
that reaches navigable waters.
Definitions
Alteration
Any work on a container involving cutting, burning, welding, or heating
operations that changes the physical dimensions or configuration
of the container.
Bulk Storage Container
Any container used to store oil. These containers are used for purposes
including, but not limited to, the storage of oil prior to use, while being used, or
prior to further distribution in commerce. Oil-filled electrical, operating, or
manufacturing equipment is not included in the definition of a bulk storage
container.
Discharge
Includes, but is not limited to, any spilling, leaking, pumping, pouring, emitting,
emptying, or dumping of oil,but excludes discharges in compliance with a
permit under §402 of the CWA; discharges resulting from circumstances
identified, reviewed, and made a part of the public record with respect to a
permit issued or modified under §402 of the CWA, and subject to a condition in
such permit; or continuous or anticipated intermittent discharges from a point
