Now <br /> 1 1C11I <br /> 2 DEFENDANTS <br /> 3 19. The defendants transact business within the County of San Joaquin and elsewhere <br /> 4 throughout the State of California. The alleged violations of the law, hereinafter described, have <br /> 5 been carried out within said San Joaquin County and elsewhere throughout the State of <br /> 6 California. The alleged actions of the defendants and each of them,jointly and separately, as set <br /> 7 out below, are in violation of the law and public policy of the State of California. <br /> 8 20. Whenever in this complaint reference is made to any act of defendants, such allegations <br /> 9 shall be deemed to mean that defendants and its officers, agents, employees, or representatives, <br /> 10 did or authorized acts while actively engaged in the management, direction or control of the <br /> 11 affairs of said defendants, and while acting within the course and scope of their duties. <br /> 12 21. Defendants UNOCAL and TOSCO at all times relevant to this complaint were the <br /> 13 owners of real property containing USTs used at an operating gasoline station located in San <br /> 14 Joaquin County and more particularly located in Manteca, California at 1700 Yosemite Avenue. <br /> 15 22. Defendant UNOCAL at all times relevant to this complaint were the leaseholders of real <br /> 16 property formerly containing USTs used at an operating gasoline station located in San Joaquin <br /> 17 County and more particularly located in Stockton, California at 1665 Pacific Avenue. <br /> 18 23. Defendants UNOCAL and TOSCO at all times relevant to this complaint were the <br /> 19 leaseholders of real property containing USTs used at an operating gasoline station located in San <br /> 20 Joaquin County and more particularly located in Stockton, California at 2701 W. March Lane. <br /> 21 24. Defendants UNOCAL and TOSCO at all times relevant to this complaint were the <br /> 22 leaseholders of real property containing USTs used at an operating gasoline station located in San <br /> 23 Joaquin County and more particularly located in Stockton, California at 4707 Pacific Avenue. <br /> 24 25. Defendant UNOCAL at all times relevant to this complaint were the owners of real <br /> 25 property formerly containing USTs used at an operating gasoline station located in San Joaquin <br /> 26 County and more particularly located in Stockton, California at 437 East Miner Avenue. <br /> 27 26. Defendants UNOCAL and TOSCO at all times relevant to this complaint were the <br /> 28 owners of real property containing USTs used at an operating gasoline station Iocated in San <br /> H:4HOME1MYOUNG\CASFMUNOCAL1COM PLAM.WPD 4 <br />
