<br /> I (b) "Local agency" means the local agency authorized, pursuant to Section 25283, to
<br /> implement this chapter. ("Cal. H & S Code" §25281(h))

<br /> (c) "Operator" means any person in control of, or having daily responsibility for, the
<br /> 3 daily operation of an underground storage tank system. (Cal. H & S Code § 25281 (i))
<br /> 4 (d) "Owner" means the owner of an underground storage tank(Cal. H & S Code
<br /> § 25281 0))
<br /> 5
<br /> (e) "Person" means an individual, trust, firm,joint stock company, corporation, including
<br /> 6 a government corporation, partnership, or association. "Person" also includes any city,
<br /> county, district, the state, any department or agency thereof, or the United States to the
<br /> 7 extent authorized by federal law. ("Cal. H & S Code" §25281(k))
<br /> 8 (f) "Release" means any spilling, leaking, emitting, discharging, escaping, leaching, or
<br /> disposing from an underground storage tank into or on the waters of the state, the land, or
<br /> 9 the subsurface soils. (Cal. H & S Code § 25281 (o))
<br /> 10 (g) "Storage" or"store" means the containment, handling, or treatment of hazardous
<br /> substances, either on a temporary basis or for a period of years. "Storage" or"store" does
<br /> 11 not mean the storage of hazardous wastes in an underground storage tank if the person
<br /> operating the tank has been issued a hazardous waste facilities permit by the department
<br /> 12 pursuant to Section 25200 or granted interim status under Section 25200.5. ("Cal. H& S
<br /> Code" §25281(s))

<br /> (h) "Tank" means a stationary device designed to contain an accumulation of hazardous
<br /> 14 substances which is constructed primarily of nonearthen materials (e.g. wood, concrete,
<br /> steel, plastic) which provides structural support. ("Cal. H & S Code" §25281(t))

<br /> (i) Unauthorized release means any release of any hazardous substance which does not
<br /> 16 conform to this chapter, including, but not limited to, an unauthorized release specified in
<br /> § 25295.5,unless this release is authorized by the board or a regional board pursuant to
<br /> 17 Division 7. (commencing with § 13000) of the Water Code. (Cal. H & S Code § 25281

<br /> (j) "Underground storage tank" means any one or combination of tanks, including pipes
<br /> 19 connected thereto, which is used for the storage of hazardous substances and which is
<br /> substantially or totally beneath the surface of the ground. (Cal. H & S Code § 25281 (x)

<br /> 21 (k)"Underground tank system" or "tank system" means an underground storage tank,
<br /> connected piping, aricillary equipment, and containment system, if any. (Cal. H& S Code
<br /> 22 § 25281 (y))
<br /> 23 (1) "Construction of chapter" means unless the context indicates otherwise, the definitions
<br /> in this article govern the construction of this chapter. (Cal. H & S Code § 25299.11)

<br /> (m) "Corrective action" includes, but is not limited to, evaluation and investigation of an
<br /> 25 unauthorized release, initial corrective actions measures, as specified in the federal act,
<br /> and any actions necessary to investigate and remedy any residual effects remaining after
<br /> 26 the initial corrective action. Except as provided in the federal act, "corrective action"
<br /> does not include actions to repair or replace an underground storage tank or its associated
<br /> 27 equipment. (Cal. H& S Code § 25299.14)
<br /> 28 (n) "Operator" means any person in control of, or having responsibility for, the daily
