Box 5004 PERMIT/SERVICES <br /> San Ramon, California 94583-0804 <br /> Re: Chevron Station No. 9-6465 <br /> 5608 North Pershing Avenue, Stockton, CA <br /> Dear Mr. Purcel : <br /> In response to your letter of September 11 , 1992, please be advised that the enclosed <br /> agreement is not in compliance with the lease and is not acceptable to the Owner. We, <br /> therefore, request that Chevron comply with the following: <br /> A. Remove all buildings, improvements, fixtures and equipment owned or placed by <br /> Lessee, its Sublessees or Licensees, in, under, or upon the leased premises by <br /> February 28, 1993. <br /> B. Remove all hazardous waste and all contamination in the soil and in the water on <br /> the premises and on any adjacent property caused by Chevron's use of hazardous <br /> chemicals. Chevron must comply with all governmental regulations, including but <br /> not limited to, the San Joaquin County Environmental Health Department, for the <br /> removal and replacement of the contamination, including the Vapor Extraction <br /> process recommended by the local Health Department. All of this must be <br /> completed by Chevron by February 28, 1993. <br /> C. When the contamination is completely eliminated and the new replacement soil is <br /> substituted and compacted according to governmental specifications, the surface <br /> of the premises will be blacktopped to Lessor's specifications and satisfaction, <br /> and completed by February 28, 1993. <br /> D. Prepare a Quitclaim Deed for execution and recording to cancel the Memorandum of <br /> Lease previously recorded. <br /> Chevron has over five (5) months within which to complete the above matters and vacate <br /> the premises by February 28, 1993. In the event the contamination is not completely <br /> eliminated or the premises completely vacated and ready for Lessor's occupancy by the <br />
