Tokay Street <br /> Lodi , CA 95240 <br /> TOWER PARK MARINA, SOIL BORING AND WELL INSTALLATION PERMIT, SAN JOAQUIN <br /> COUNTY <br /> Our 18 August 1992 letter to Tower Park Marina, of which we sent you a copy, <br /> approved the revised site assessment work plan for the subject site. <br /> The assessment work which includes soil borings and well installations is <br /> necessary to identify the extent of soil and ground water contamination from <br /> aboveground tank leaks at Tower Park. As stated in the letter, we requested <br /> Tower Park to submit by 1 September 1992 a schedule for submission of the site <br /> assessment report. During telephone conversations with Tower Park's consul- <br /> tant, Law/Crandall , Inc. (LCI) , Ms. Susan Gahry stated that she could not <br /> provide a schedule to the Board until she got the soil boring and well <br /> drilling permit from the District. The latest correspondence from Ms. Gahry <br /> indicates that the indemnity clause in the permit issued by the District is <br /> too stringent. Consequently, LCI proposed suggested language which is more <br /> feasible. <br /> We are concerned that further delays in performing the assessment work will <br /> result in spreading the contaminants especially with the onset of the rainy <br /> season. If further delays occur in this project, we may require the District <br /> to perform the assessment work since some of the affected areas are within <br /> District property.
